About These Terms And Conditions

In these Terms and Conditions "we" and "us" mean PhotoSorcerer.com, and "you" means you the customer.

These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Services. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.

Payment Methods And Processing

PhotoSorcerer.com uses PayPal.com to handle payments on our behalf. Currently accepted methods of payment are PayPal transfer, Visa, MasterCard and American Express.

Payment processing will not begin until we receive all the information we need.

When you place an order, we will redirect you to PayPal's web site where you can enter payment information for the order. This information will remain with PayPal, and you will only be charged when the service has been performed and the order closed.

When a completed photo becomes available, you will be notified via email and the photo will be shown in the member area of the Web site when you log in. You must accept or decline the photo within 3 days. If, beyond this period, no action has been taken, we will deem it as acceptance on your part, and charge the amount that has been held for this photo.

For credit card and PayPal payments we will email a tax invoice to you with your Order Confirmation. Your tax invoice is your proof of purchase.

Please note:

  • Debit cards and cheque cards have daily spending limits that may substantially delay the processing of your order.
  • You may be required to provide further identification for additional security reference checks.
  • If your PayPal payment is funded by an echeque this may substantially delay processing your Order while payment clears.

Prices

PhotoSorcerer.com always aims to provide quality services with the most competitive prices.

PhotoSorcerer.com reserves the right to change prices for services displayed at PhotoSorcerer.com at any time.

Coupons

A coupon can be used by entering its code at the appropriate point in the online order process. Your use of a coupon may be subject to you providing proof of entitlement to use the coupon. Your use of a coupon indicates your agreement to be bound by these coupon Terms and Conditions:

  • Coupons are identified by unique random numbers that are known to only you and those you authorize. You must take proper care to protect coupon numbers. Failure to do so may result in other people gaining unlawful access to your coupons and potentially use them for their own purchases. PhotoSorcerer.com under no circumstances can be responsible for losses arising from your failure to protect your coupons' confidentiality.
  • Coupon sales are final and non-refundable.
  • Coupons are transferable.
  • There is a limit of one coupon per order.
  • A coupon cannot be used in conjunction with other discounts or promotions.
  • A coupon cannot be applied to past purchases.
  • A coupon has no cash value.
  • Coupons may not be combined.
  • Coupons and/or coupon codes may only be used for sales conducted via the PhotoSorcerer.com web site.

Referral reward programme

You can accumulate referral reward points when you refer your friends to us. A referral occurs when you introduce someone previously unknown to PhotoSorcerer.com and that person has completed the first order with us. The reward points will be added to your account when your referred friend first accepted an edited photo from our Web site.

You can redeem your reward points at any time. You will receive a coupon with the equivalent of your redemption value. Your use of this coupon is subject to the Terms and Conditions stated in section Coupons in this document.

The dollar value of your redemption may change depending on when you redeem it, as it is calculated based on the price of the Basic package available at the time of redemption.

Our Liability

We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.

Our maximum aggregate liability for any Service supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Service(s) in question.

Your Data - Use And Protection

By placing your Order, you agree that we may store, process and use data collected from you for the purposes of processing your Order. For more information, please refer to our Privacy Statement.

Credit Card Fraud

We rely on PayPal.com to handle payment processing, with its well-known security mechanisms and infrastructures. All credit card related transactions are conducted securely using the latest in Secure Sockets Layer (SSL) technology software, and all your credit card information is stored securely at PayPal's facilities. PhotoSorcerer.com will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

General

You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of PhotoSorcerer.com. Any unauthorized assignment shall be deemed null and void.

If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby.

Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.

PhotoSorcerer.com reserves the right to change the Terms and Conditions of sale at any time.

No PhotoSorcerer.com employee or agent has the authority to vary any of the Terms and Conditions governing any sale.

Force Majeure

PhotoSorcerer.com shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of PhotoSorcerer.com, and PhotoSorcerer.com shall be entitled to a reasonable extension of time for the performance of such obligations.
